Vehicles Mashed Between Dump Truck and Semi
A semi with two SUVs behind it were stopped for a red light at an intersection. A dump truck approached from behind and failed to stop, crashed into the vehicles, smashing the two SUVs into the back end of the semi. The driver of the dump truck claimed that the sun was in his eyes and he didn’t see the vehicles stopped ahead of him. Our client was in one of the two SUVs crushed between the two trucks.
Our client was taken by ambulance to HCMC and spent 12 days in the hospital. She suffered a traumatic brain injury, a knee injury that required surgery and a cervical fracture. She had a laceration in her head that required staples. Her brain injury impeded her ability to work and to participate in therapy for her knee rehabilitation. She will require a total knee replacement in the future due to the damage from the crash. Our client’s medical expenses exceeded $138,180.
Paul Downes recovered all insurance coverage that was available. He settled the claim for $663,219 from the dump truck company’s insurer and $500,000 settlement from our client’s underinsured policy.
